Terms of Service

These Terms of Service ("Terms") govern your access to and use of www.profitshapers.com (the "Site"), operated by Profit Shapers, Inc. ("ProfitShapers," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms cover the marketing website only. The separate ProfitShapers application platform you sign into after creating an account is governed by its own agreement — the ProfitShapers Terms of Service v3.0 (effective July 10, 2026) — which is presented to you and accepted when you create that account. Eligibility

The Site is intended for businesses and for individuals who are at least 18 years old and able to form a binding contract. By using the Site, you represent that you meet these requirements and that any information you provide is accurate.

Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own informational and business-evaluation purposes. You agree not to:

• Use the Site in violation of any applicable law or regulation.
• Copy, reproduce, republish, or redistribute Site content except as expressly permitted.
• Attempt to gain unauthorized access to the Site, its systems, or its networks.
• Interfere with or disrupt the Site, including by introducing malware or placing an unreasonable load on our infrastructure.
• Use automated means (bots, scrapers, crawlers) to access or collect data from the Site without our prior written permission.
• Submit false, misleading, or fraudulent information through any form on the Site.

Intellectual property

The Site and its content — including text, graphics, logos, images, layout, and software — are owned by ProfitShapers or its licensors and are protected by intellectual property laws. "ProfitShapers," our logo, and our product names are our trademarks and may not be used without our prior written permission. All rights not expressly granted are reserved.

Submissions

When you submit information through the Site — for example a walkthrough request, trial inquiry, or partner application — you confirm that the information is accurate and that you are authorized to provide it. We handle that information as described in our Privacy Policy.

Third-party links and services

The Site links to third-party services, including the ProfitShapers Hub sign-in and assessment flows. We do not control those services and are not responsible for their content, availability, or practices. Your use of any third-party service is governed by that service's own terms.

Disclaimer of warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on it is complete or current. Content on the Site is for general informational purposes and is not professional, financial, legal, or advisory advice.

Limitation of liability

To the fullest extent permitted by law, ProfitShapers and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (USD $100).

Indemnification

You agree to indemnify and hold harmless ProfitShapers from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or your violation of these Terms.

Changes to the Site and these Terms

We may modify or discontinue the Site, or update these Terms, at any time. When we update these Terms, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
